Since a video dealer named "thebarry" has maintained a good reputation, I bought several videos during a recent sell off of new items. After the sale and purchase, I was informed that they would take up to 10 days to ship. This was 3 weeks ago, yet I have not received any of the videos. The seller's feedback turned ugly and went private. They no longer have any items up for auction. Alarms are going off here and I can not contact this outfit. Any insights?

and how did you pay for the videos?

and if you cannot get in touch with them at all....be sure to file fraud charges with ebay(but only after 30 days from auction end)

dancing.. I thought I'd check the boards on the off chance that someone else might complain about this guy. I also purchased from "thebarry" with auction closing Feb. 15 and still have not received my video. I paid $100 for my video too. I wrote him several emails last week, and he responded 3/1, saying that they sold a much larger quantity than anticipated which fueled the delay even further and that it was shipped 2/23 via media mail which could take 7-10 business days. Then some b.s about their commercial insurance if it doesn't arrive after so many days, effective 30 days after ship date, yada, yada... I also checked his feedback this morning and didn't like what I saw. Not sure what to do now, wait another week? I feel kinda helpless since he changed his feedback to private.

Sure looks odd to me. Could this be fraud? They had pretty good feedback until about a month ago, when the negs started coming. Wonder why they made their feedback private?

Makes them look more like con artists to me. I sure wouldn't bid on any of their auctions.

To anyone that has not received their merchandise, pull thebarry's contact info and try calling to see whats up! If it's phony turn them in to eBay for suspension.

Remember that according to the mail order rule, they do have up to 30 days after receiving payment before they are required to ship - unless they told you they'd ship within a shorter period. If you paid using PayPal, don't let their 30 day time limit on complaints to expire if you haven't received your stuff.

Great info, opinions.etc & Hobbit. I pulled the full name and phone number from eBay records and got his PO Box # from his own listings. With these I was able to give the USPS, FBI and Fraud sites the info they requested. I also found that it may be possible to find out where he lives. I will be passing through there next week on my way to a film screening. Any of you wish to join me if I can locat him?

I have been sending out inquiries to buyers of these items, beginning with those whose auctions closed over 30 days ago. Of approximately 15 responses so far, not one buyer has received a single video. This doesn’t look good for any of us.

Last time I saw that kind of a downturn in a dealer's feedback, it was because they had an entire UPS shipment of items lost. Dozens of people, all their goods lost. (In similar situations, it's been human error--a new employee not adding enough postage or getting zip codes wrong, addresses mixed up, being crooked, etc.) One or two left negs, and that began the landslide--people who might not've assumed they were being ripped off read those negs and decided they were, and started leaving their own negs. Most were done before they even contacted the seller, from the looks of things.

Be prepared to follow through as necessary with PayPal and fraud protection etc., but give the seller an opportunity to make it right, too. 23,000+ good transactions, 52 bad ones, half of them in just the past month? I'm gambling on a lost UPS/USPS shipment, or a new employee who's screwed up. If these guys are for real, they'll do everything they can to make it right.

He wrote me stating that he was leaving on vacation this week Tuesday - 2
days ago. I think he ripped off all of us. But he did have feedbacks from
audioguild , twohats(or something like that) sellhollywood, and a few more.
I know these were not factory sealed videos however as he told me this. He
stated they were brand new but opened for easier storage. I had purchased
about 40 to 50 videos from him. He said he sent the first shippment out on
Feb. 19th and it was 9 videos. As of the 19th - I had about 20 plus videos
paid for so this confused me. He then told me that he sent another batch on
Feb. 28th , well I have yet to receive anything. I believe he told everybody
that he would be shipping these out 10 days later so they couldn't file a
claim with paypal as it is only 30 days. He continued to tell me that he

YES! I've been asking many members myself! I did not get the rare movie I paid a LOT of money for and barry re-listed it THREE times after I won it.

I'm SO GLAD YOU WROTE !! I've been put off by people saying that they will wait for more time. It was FEB 5th when I won my order. Barry said he shipped it FEB 14th. If we wait to long he will be on a Island far away with 100's of 1000's of dollors!

IF EBAY WON'T RESPOND WE SHOULD GO TO THE MEDIA RIGHT AWAY!!! Ebay would hate a huge story of how over a thousand people lost money too e-crime! THANK YOU KEVIN

Hello,

I have ordered (and received) videos from TheBarry in the past. I have yet
to receive the first two videos I won from him in his latest batch. I paid
for them on February 15th and noted his comment that shipment may be
delayed. I since won a further 5 videos from him, which I have not yet paid
for, in anticipation of receipt of the first order. My past experience with
him was excellent, but I appreciate the warning and will hold off on payment
until I hear more.

Thank you for this email!!!

I have not sent out any money yet to thebarry because he has NOT responded
to my email messages, has HIDDEN his feedback - it is now private, and have
noticed that he has received TOO MANY NEGATIVE COMMENTS that I cannot read
due to his PRIVATE feedback choice.

I contacted eBay just today asking them about this, but haven't heard back
yet. I have purchased from Barry in the past and have never had a
problem. I'm glad that I've waited to send the money though. Perhaps he
was just overwhelmed by the volume of auctions and had gotten behind.

Would you PLEASE keep me updated? I got a bad feeling about this and
that's why I waited to send the money and why I contacted eBay today. I'll
let you know if I receive a response to my email messages to Barry.

Yes, I am quite puzzled in regards to this matter. I sent him an e-mail
early last week and he said that my item was in fact shipped on February 15
and that if it did not arrive by Tuesday (March 5) to notify him. I have
sent him several e-mail's in the past few days and have not gotten any
response. I decided to check his feedback and noted many negatives, but I
could not read the feedback. The seller decided to make it private. I
requested his name and phone # from e-bay and tried to call, but no one
answered the phone. I also noticed that he is not selling any other items.
I spent approximately $40 for a rare hard to find video and have not
received it. I do not know what the problem is. I wish he would respond or
explain. It seems as though he has had a long relationship with e-bay, and
that he is not a scam artist, however I have not received any explanation as
to why this is happening. Please keep me informed as to what forms of
action you are taking. Thank you for your e-mail. It is good to be able to
communicate with other disgruntled buyers.

I have now contacted 100 buyers. 24 have responded. Aparently none have received even a single video. Most state that they have attempted contact with theBarry with no response. I do not believe that this merchant intends to honor any of the sales.

The e-mail talks about a creditor placing a lien on the estate holding the movies and the court has ordered thebarry to hault shipments of movies.
The e-mail goes on to say this should be resolved within 30 days. Thebarry did refund my money to my paypal account. The e-mail also states the movies will ship when problem is resolved. HOWEVER, I DON'T KNOW WHAT TO THINK. STEVE

There have now been 46 replies to my inquiries, yet not a single buyer's message indicates receipt of even a single video that was sold by "TheBarry" during this estate sale in February. According to SteveCathy, on March 1st he shifted his communications. Initially claiming to have shipped the items, while blaming the Media Mail system, he now apparently states that his shipments were stopped out by a court order:

I RECOMMEND THAT APPROPRIATE ACTION BE INITIATED WITH THE AGENCIES THAT CONCERN THEMSELVES WITH ISSUES SUCH AS THIS.

I won the eBay bid on one Disney video (2/06/02) and two Disney videos (2/14/02) and another one Disney video (2/16/02) from 'TheBarry). I wasn't receiving them for sbout three weeks. I contacted him, and he told me on around (3/1/02) that the post office probably lost them. He said over a week ago that he was refunding my $204 plus at that time. In a week and a half now I have not seen the videos arrive or gotten the refund from him (Barry Riegel in Illinois). What gives on this and where did he disappear too.

I just discovered that I've been ripped off by this clown. thebarry's mail account is now closed. I wonder if AOL knows that he was using it for fraud.

I'm also pretty hacked with eBay. What's this business of leaving his feedback private even after he's been suspended? And why does eBay allow someone to close their feedback from the public while they have outstanding auctions?

It is any user's right to take their feedback private. You can do it, I can do it, and thebarry can do it.

And why does eBay allow someone to close their feedback from the public while they have outstanding auctions?

There are a variety of reasons why a user might rightfully choose to take their feedback private. I suppose that hiding negative comments is the most common reason, but it's not the only reason. eBay allows anyone to go private, at any time. eBay cannot force a user to keep their feedback comments "public". Most users view hidden feedback as suicidal, I know that I would never bid with a seller with hidden feedback, regardless.

Besides, only the actual comments themselves are hidden, anyone can still see that thebarry received 100+ negatives in the last week.

I think it's safe to assume that the negatives all have to do with non-shipping. What info could be in the feedback comments that would actually be helpful to you?

Count me in as well! Another victim of this unfolding scam! Six videos won, payment sent on 2/19, received on 2/26 with confirming e-mail from thebarry, and now, 3/11, still no videos, no explanation, no nuthin'. This is an absolute disgrace! I suspected that I was conned by the mere fact that the e-mail he sent did not indicate where the videos would be shipped from. Also the fact that his feedback went south so quickly along with hiding the comments. I agree with timglenn, feedback comments should be available for all to see after the seller becomes NARU, which is what happened to thebarry today. I suggest all who were scammed should contact the Chicago area media (WBBM-2, WMAQ-5, WLS-7, Chicago Tribune, etc.) since this is where his "operation" is located! He needs to be exposed!

I won 42 videos - it did seem too good to be true in retrospect! Jeez! How many brand new videos are left in the world of such great films anyway? But I'd done business with thebarry in the past and it was smooth. Guess he was counting on that. He even sent that great microwave popcorn! Ebay's response irks me - this afternoon they stated in an email that he was not a registered seller. Hello! As of when? The worst thing is that now I have to track down all those great movies again. I hope no one is out the money. Contact your credit card companies and file a dispute, if you haven't already. I too wonder how long he was planning this. I also wonder who bought the most videos and who paid the most for them.

Count me among the many many "victims" of "thebarry". I won 3 auctions from this sell off of a midwest distributor and in spite of numerous attempts to get a response I haven't received either the videos or any explanation.
SOMEONE IS getting his phone messages because at times I am able to leave a message. However other times I get a message saying "the memory is full".
I talked with "Kobe" at Ebay earlier today and he told me there are numerous fraud complaints Ebay is investigating. He did inform me the user had been suspended as of early this morning but he refused to provide further details and when I asked him to once again make the feedback available to users to read, he said that was a privacy issue and he was prohibited from doing so.
Even as the user was suspended!!!! Go figure!!!!
Protecting this seller makes no sense to me and to my mind makes Ebay just as responsible for the current and continuing situation as the seller.
I was able to leave negative feedback and I filed a complaint with the local BBB in his area. Since I paid via billpoint I don't think the postal service will be of use to me in investigating this. I believe someone should contact their local newspapers and let them know about this. This is inexcusable on Ebay's part as well. Ebay needs to be held accountable.

I regretfully include myself with those ripped off by thebarry. Its weird that some people have gotten some email responses, I sure didn't. I won my item 2/15, paid 2/16. Why would this guy respond to anyone at all? I emailed him many times and never heard a word. Also called and left phone messages. What a sad, pathetic situation. To find other people that lost money to "thebarry " go to ebay.com click on "search ", then click on "by seller ", Include completed items select "ALL ", type in " thebarry " this also will show the scope of how large and complex this scam was. Most of the high dolor items were relisted and sold as many as four times. One of the items that I ordered was a very, very rare movie. This movie was listed as never played and in the original package. It relisted three times after I won it and sold every time for a LOT of money. Further to the previous post (#50), some of the information above has been added to the page , along with local police contacts . If there is a buyer somewhere near Chicago , could they get the ball rolling by formally complaining to the USPS and the local police . The first thing to be done is to have the CO Box sealed .

It looks like I was also scammed for three videos. I did receive an email telling me they had been shipped but that was nearly 20 days ago. After all I've read, I don't expect to receive anything. The sad part is this makes three times I've been scammed on eBay in the last few months; this just happens to be the worst. I'd never had any problems before until recently. What is going on?

Well... it is my experience (and opinion) that there are more and more crooks on ebay then there used to be trying to make a quick buck.

I am extremely cautious of any transactions I make on ebay today. I am sure the honest people outnumber the dishonest, but the ratio is rapidly changing, in my opinion.

I research all previous transactions before I bid, especially if the items value is $20.00 or more. I have been overall quite successful with purchases on ebay, purchasing items with a price of as much as $1800.00. It is the few "losers" that ruin it for most of us.

The bottomline will always be "buyer beware".

Sadly, I have to include myself in the ever growing list of people shammed by thebarry. I was the high bidder on 6 of his auctions totalling $150. I have received several emails from him, the most recent explaining how there would be a slight delay in receiving the tapes due to the tapes being held in another location. Sadly that was a few weeks ago and I've heard nothing since and of course no tapes have arrived. I am very surprised that ebay have not made an announcement on the site considered the scale of the cam and how damaging it is to their often talked about "community". I'm not suggesting ebay can be held accountable financially for our losses, I agree that it's "buyer beware", but their lack of advice, support and sharing of information leaves much to be desired. I realize they don't want to shout this kind of event from the rooftops but the head in the sand approach is going to cost them dearly, in terms of lost custom due to lack of confidence. Come on Ebay, keep us in the picture. You must know what's going on.

I too have apparently been defrauded on a set of DVDs ($65) that I won in an auction with this seller. My experience is the same as everyone else who is posting about the problem -- stalling tactics to explain delays shipping the items -- being told items were sent, but nothing arriving -- email being returned because box is full, etc. Now that ebay has suspended the account, bidders with a problem can't even leave feedback. Checking under "search" "seller" I believe only shows transactions for the last 30 days. Is that correct? If so, my transaction is just past the 30 days -- so already the scope of the problem -- number of people involved -- will be not be completely accessible. Clearly just checking what we can currently see reflects that a large number of people have been affected by this seller.

I am cautious when I buy, but felt confident when I checked his feedback and saw over 17,000 positive feedback postings (actually 23,000+ actual positive comments total) and very few neutrals or negatives. I take "buyer beware" seriously, but at what point do we feel safe in bidding? How much more feedback does a seller need before a buyer can feel safe? If it isn't 17,000+ then what? I contacted Ebay last week and they expressed concern and encouraged me to file a fraud report and contact other agencies which I am in the process of doing. But even though it won't change a thing, I wish I could find out what on earth happened with this guy. How could a seller amass such a huge amount of positive feedback and then have this happen.

It seems that I have learned a hard lesson here - 18 scam videos, minus $300. And there is so little that can be done to correct this awful situation. Thanks to Jerry for alerting me to this slick scam.

I feel so terrible about all those buyers that lost their money to this scumbag. I'm a victim too of this crook, and I hope he doesn't get away with this scam. If he took in over $300,000 for this scheme of his, then does the IRS get involved in this too? and what about eBay fees and Paypal fees - were they already deducted from his account?

Best bet for all of us is to file a complaint with the Illinois Attorney General's Office of Consumer Affairs. The more complaints they get on this individual, the more vigorous the action will be taken.

I'm still kind of shocked, though. My business with this guy in the past has been nothing short of excellent --far exceeded my expectations as a seller.

However, I've got over $100 at stake here.

Yes, I too, was duped by thebarry. I waited so long to investigate this myself because I ,like ebay, think all people are basically good--ask me if I believe that crap now! It is unfortunate ebay takes no ownership in issues such as these, as these such issues could mean the ultimate demise of the auction site powerhouse.
So,I called and left a message on thebarry's machine, no response...emails, also , no response.
Anyone have any idea what total dollar amount we're talking about? Mine was $90 for 4 videos. I am so glad I didn't win that Child of Glass video at 122.50--I feel sorry for that ebayer!I would like to know how steve(?)got a refund out of him on PayPal!I emailed the local news show in the barry's area--thanks to whoever posted that!
Is there anyway we can get a class action suit against this guy?
Where do we go with this people?????

Oh, forgot to mention one other thought...So, I have a poll (sort of)...in hindsight, how many of you actually wondered what such estate/former business or whatever the "source" of these videos was, would have SO MANY NEW SEALED videos of old release titles?? No pictures of these should have been my first clue, but I figured the lot was so large he couldn't possible scan that many!The 17,000+ positive feedback did it for me too...Yes,I fell for it hook, line, sinker YET, now, will trust my rationale next time for sure! Good lesson, somewhere in this, I am sure...

Either way , he should have at least refunded the money and given an honest reason for the delay.

I did wonder why these videos were stored for so long and unopened...over 20 yrs ago? and still in their original shipping boxes? and why did this (supposedly) mid-west distributor decide to retire at the time he still had this massive holding of new videos in which to sell yet? He could have sold them off first before retiring. I don't get it. But like everyone else who got duped by this rotten crook, I too had gone by his 17,000 positives and long-standing good reputation as an ebay seller since '98.

I must say this is nuts I belived in thebarry because of his 17000+ feedback I thought hay a guy like this is great (Like the USPS site say's if its to good to be true then you know its a SCAM) One thing I didn't catch was that all the auctions where Ending almost in the same day which should have been Warning Signs something to watch for in the future. I suckered for his auction hook line and sinker 5 lots more darn nire 1,200.00 which is one hell of a lot to me I'm just so glad I lost a few (I was upset at
myself for losing a few that should have won.
I Just wishing I would have LOST ALL OF his auctions .( 2.What can we do it seems that's
what everywhere wont to know . Were I go it seems to dead-end. I am into this for over $2000.00. Barry has always been cool up to now. Here's some info I found out.

These videos were from a $10 Million bankruptcy. There were offered to an associate of mine for 1.3 million.

From what can piece together Barry got involved with this at some level. Perhaps the people he was dealing with weren't happy with their cut.

Also, Ebay clearly states that all product has to be on hand. This wasn't the case. This sale lasted over a week. The fact that the seller had an Ebay store and a high feedback rating also fostered false confidence.

Ebay is responsible for this as well as Barry. This was no fly by night sale. HE also used his Ebay store to promote the next big sale which also bought him some time.

Anytime a seller makes $300,000.00 in sales in such a short period of time it should set off some flag on ebay and someone should look into this.

Where are the site safeguards?

If ebay does nothing about this scam and lets us all fly in the wind they are going to get a ton of really bad word of mouth and publicity over this.

Not too mention that some of us should group together and sue them along with Barry.

I am not a happy ebayer today!
